1-204. POSITIONS IN THE JUDICIAL BRANCH.

EXCEPT FOR THE POSITIONS IN THE DISTRICT COURT OF MARYLAND THAT
ARE LISTED IN § 1-302 OF THIS TITLE, ALL POSITIONS IN THE JUDICIAL BRANCH OF
STATE GOVERNMENT ARE EXCLUDED FROM THE STATE PERSONNEL MANAGEMENT
SYSTEM.

REVISOR'S NOTE: This section is new language added to state expressly that,
except for those positions listed in § 1-302 of this title, positions in the judicial
branch are excluded from the State Personnel Management System. See

generally, 77 Op. Att'y Gen. ____ (1992) [Opinion No. 92-016 (May 20,

1992)].

Former Art. 64A, § 3(3), as it excluded from the classified service registers of
wills and clerks of court, and § 3(16) and § 4(5), which excluded from the
classified service certain employees in the Circuit Court for Baltimore City
and employees of the State Law Library, are deleted as unnecessary in light of
the broader exclusion, under this section, from the State Personnel
Management System.

As to specific provisions for personnel systems in the judicial branch, see Title
2, Subtitles 4, 5, and 5A of the Courts and Judicial Proceedings Article.

1-205. POSITIONS IN THE LEGISLATIVE BRANCH.

ALL POSITIONS IN THE LEGISLATIVE BRANCH OF STATE GOVERNMENT ARE
EXCLUDED FROM THE STATE PERSONNEL MANAGEMENT SYSTEM.

REVISOR'S NOTE: This section is new language added to state expressly that all
positions in the legislative branch are excluded from the State Personnel

Management System. See generally, 77 Op. Att'y Gen.____ (1992) [Opinion

No. 92-016 (May 20, 1992)] n.7.

Former Art. 64A, § 3(2), which excluded from the classified service officers
and employees of the General Assembly, is deleted as unnecessary in light of
the broader exclusion of those employees, under this section, from the State
Personnel Management System.

Former Art. 64A, § 8, which included in the classified service assistant
auditors employed in the State Auditor's office, is deleted as obsolete. The
functions of the former State Auditor have been transferred to the Legislative
Accounting Office in the Department of Fiscal Services.
