Ch. 10

EXCEPT AS PROVIDED IN THIS SECTION OR OTHERWISE BY LAW, ALL
POSITIONS IN THE EXECUTIVE BRANCH OF STATE GOVERNMENT ARE IN THE STATE
PERSONNEL MANAGEMENT SYSTEM, INCLUDING ALL CLASSIFIED SERVICE,
UNCLASSIFIED SERVICE, FULL-TIME, PART-TIME, PERMANENT, TEMPORARY EXTRA,
TEMPORARY PENDING, EMERGENCY, AND CONTRACTUAL EMPLOYEES.

(B) POSITIONS IN INDEPENDENT PERSONNEL SYSTEMS EXCLUDED.

EXCEPT TO THE EXTENT OTHERWISE PROVIDED BY LAW, ANY POSITION IN A
UNIT IN THE EXECUTIVE BRANCH OF STATE GOVERNMENT WITH AN INDEPENDENT
PERSONNEL SYSTEM IS EXCLUDED FROM THE STATE PERSONNEL MANAGEMENT
SYSTEM.

REVISOR'S NOTE: Subsection (a) of this section is new language added to
expressly state that, unless otherwise provided in this section or by other law,
all positions in the executive branch are in the State Personnel Management
System. For a general exclusion of elected and Constitutional officers, of
whatever branch of State government, see § 1-202 of this subtitle.

Subsection (b) of this section is new language added to state expressly that,
except to the extent otherwise provided by law, positions in units with
independent personnel systems are excluded from the State Personnel
Management System.

As to subsection (b) of this section, units in the executive branch that are
wholly or partly excluded from the State Personnel Management System
include the following:

(1)  Chesapeake Bay Trust [NR § 8-1909(a)(1)];

(2)  Department of Transportation [TR § 2-103.4];

(3)  Maryland Economic Development Corporation [Art. 83A, § 5-104(c)];

(4)  Maryland Food Center Authority [Art. 41, § 13-105(9)];

(5)  Maryland Higher Education Loan Corporation [ED § 18-1005(a)(2)];

(6)  Maryland-National Capital Park and Planning Commission [Art. 28, §

2-112];

(7)  Maryland Stadium Authority [FI § 13-718(3)];

(8)  Military Department [Art. 65, § 9];

(9)  Northeast Maryland Waste Disposal Authority [NR § 3-903(j))];

(10)  St. Mary's College of Maryland [ED § 14-208];

(11)  University of Maryland Medical System Corporation [ED §
13-1B-05(b)];

(12)  University of Maryland System [ED § 12-111]; and
