Ch. 10                                       1993 LAWS OF MARYLAND

REVISOR'S NOTE: This subsection is new language derived without substantive
change from former Art. 64A, § 1(1).

The references to an "individual" and a "unit of government" are substituted
for the former references to a "person" for clarity. The term "person", as
defined in subsection (h) of this section, expressly excludes governmental
entities or units. On the other hand, a board, committee, or other
governmental unit, which is thus excluded from the definition of the term
"person", might well be designated by some other law as an appointing
authority. Accordingly, the term "unit" is necessary to accommodate that
situation.

See General Revisor's Note to this Division I for a discussion of the use of the
word "unit".

(C)     CLASS.

"CLASS" MEANS A CATEGORY OF ONE OR MORE SIMILAR POSITIONS, AS
ESTABLISHED BY THE SECRETARY IN ACCORDANCE WITH THIS ARTICLE.

REVISOR'S NOTE: This subsection is new language derived from the reference in
former Art. 64A, § 1(4) to the grouping of one or more similar positions.

The balance of former Art. 64A, § 1(4) is revised in the substantive provisions
of § 2-107 of this article.

Defined terms: "Position" § 1-101
"Secretary" § 1-101

(D)     CLASSIFIED SERVICE.

(1)      "CLASSIFIED SERVICE" MEANS ALL OF THOSE POSITIONS IN THE
STATE PERSONNEL MANAGEMENT SYSTEM THAT ARE GOVERNED BY TITLE 4 OF
THIS ARTICLE.

(2)      "CLASSIFIED SERVICE" DOES NOT INCLUDE ANY POSITION THAT IS:

(I)      INCLUDED IN THE UNCLASSIFIED SERVICE UNDER SUBTITLE 4
OF THIS TITLE; OR

(II)     EXCLUDED FROM THE CLASSIFIED SERVICE UNDER SUBTITLE
5 OF THIS TITLE.

REVISOR'S NOTE: Paragraph (1) of this subsection is new language substituted
for former Art. 64A, § 1(6) for clarity.

Paragraph (2) of this subsection is new language added, also for clarity.

As to paragraph (2)(ii) of this subsection, most of the employees listed in
Subtitle 5 of this title are not governed by Title 4 of this article and would not,
therefore, fall under the basic definition of "classified service" in paragraph
(1) of this subsection; they are nonetheless referred to here as exceptions for
emphasis.
