The State Department of Education shall not
expend funds for any job or position of
employment approved in this budget in
excess of 1,427 1,447 1,443 positions,
including full-time equivalent special
payments, contractual positions (defined as
the quotient of the sum of the days worked
by all such employees in the fiscal year
divided by 245) of the total authorized
amount established in the budget for the
State Department of Education at any one
time during the fiscal year 1994. The State
Superintendent of Schools shall utilize her
prerogatives under the Education Article,
Section 2-103, to implement this provision,
provided, however, that any authorized job
or position to be filled above the ceiling,
including all 1,427 1,447 1,443 full-time
equivalent positions, as detailed above, is
approved by the Board of Public Works and
counted against the limitation imposed by
the General Assembly. The establishment
of new jobs or positions not authorized in
the fiscal year 1994 budget shall be subject
to the State Finance and Procurement
Article, Section 7-236 and the limitation
imposed by the General Assembly.
It is the policy of this State that local school
systems shall ensure that State and local
education aid results in demonstrated
