* Resolutions 93-01 and 93-02 were adopted January 11, 1993. On January 6, 1993, the
Court of Special Appeals of Maryland reversed an order of the Circuit Court for Prince
George's County and ruled that Resolutions 90-09 and 90-10, which amend Sections 905
and 403, respectively, of the. Charter of the City of Seat Pleasant, are invalid and
inoperative since the posting and publication requirements in Article 23A of the
Annotated Code of Maryland were not satisfied. See Frank J. Blackwell v. City Council
for the City of Seat Pleasant, 94 Md. App. 393, 617 A.2d 1110. This ruling may affect the
validity of the purported changes in Resolutions 93-01 and 93-02.

RESOLUTION OF THE COUNCIL OF THE
TOWN OF SMITHSBURG, MARYLAND
TO AMEND THE CORPORATION CHARTER
SECTION 31-3. NUMBER OF COUNCILMEN; SELECTION; TERM
RESOLUTION of the Council of the Town of Smithsburg, Maryland, adopt pursuant to
Article XI-E, Section 4, of the Constitution of the State of Maryland, entitled,
"MUNICIPAL CORPORATIONS, PROCEDURE FOR ADOPTION, AMENDMENT OR
REPEAL OF CHARTERS"; and pursuant to Article 23A of the Annotated Code of the
Public General Laws of Maryland, entitled "Corporations, Municipal, Charter
Amendments", as said sections were enacted by Charter 423 of the Laws of Maryland,
1955, and subsequent amendments thereto; to amend the now existing Section 31-62 of
the Corporate Charter of the Town of Smithsburg as adopted March 5, 1957, and
subsequently amended entitled, SECTION 31-3. NUMBER OF COUNCILMEN; SELECTION;
TERM, and to amend said Corporate Charter as herein set forth.

found in the compilation of Municipal Charters of Maryland (1990 Replacement
Edition), repealed and reenacted, with amendments.
