Environment - Oil Contaminated Site Environmental Cleanup Fund and Underground
Storage Tank Upgrade and Replacement Fund
FOR the purpose of creating an Oil Contaminated Site Environmental Cleanup Fund;
establishing a certain fee, in addition to the current fee, for certain persons
transferring oil, except heating oil, in the State; providing for the duration and
application of the fee; providing for the abatement of the fee under certain
circumstances; establishing a certain fee for a certain period of time for certain
underground oil storage tanks to be paid into the Fund; providing for the
management of the that Fund; authorizing the that Fund to be used for certain
purposes; prohibiting the use of the that Fund for certain purposes; requiring the
Department to establish an early detection incentive program; establishing certain
deductibles and eligibility criteria for the Fund; requiring the Department of the
Environment to adopt certain regulations by a certain date; defining certain terms;
extending to a certain date the existence and functions of the Underground Storage
Tank Upgrade and Replacement Fund; extending to a certain date the collection of
certain fees under the Underground Storage Tank Upgrade and Replacement
Fund; requiring the Department of Budget and Fiscal Planning the Environment to
study and make certain recommendations on certain oil cleanup issues by a certain
date, in conjunction with certain entities; providing certain funding for the Oil
Contaminated Site Environmental Cleanup Fund for certain fiscal years; providing
for the effective date of this Act; and generally relating to underground storage tank
cleanup activities.
