Maryland Building Performance Standards
FOR the purpose of requiring the Department of Housing and Community Development
to adopt the BOCA National Building Code as the Maryland Building Performance
Standards; providing that the Standards shall apply to all buildings and structures
within the State on or after certain dates; authorizing local jurisdictions to adopt
amendments to the Standards subject to a certain limitation; providing that if a local
amendment conflicts with the Standards the local amendment shall prevail;
requiring local jurisdictions to implement and enforce the Standards as of certain
dates and setting forth minimum activities that local jurisdictions must implement
and enforce; authorizing local jurisdictions to charge fees necessary to cover the cost
of implementation and enforcement; providing that the Act does not abrogate
existing zoning power or related authority of counties and municipalities and does
not alter or abrogate the authority of certain State boards or the Commissioner of
Labor and Industry; providing that the Department, after complying with certain
procedures, shall determine whether modifications to the BOCA National Building
Code should be incorporated into the Standards; making certain provisions of this
Act subject to a certain funding contingency; requiring the Department to establish
and maintain a central automated data base containing certain items; authorizing
the Department to charge fees for information from the data base except in certain
cases; requiring a local jurisdiction to furnish the Department with certain items on
or before certain dates; establishing certain duties and powers of the Department;
clarifying certain findings of the General Assembly with respect to the Model
Performance Code; clarifying that certain parts of the Model Performance Code
shall incorporate by reference the Standards authorized by this Act; and generally
relating to the adoption of Maryland Building Performance Standards.

Preamble
WHEREAS, The administration and enforcement of a building code is necessary
to protect public health and safety, and Maryland is one of only 18 states without a
statewide building code; and
