WILLIAM DONALD SCHAEFER, Governor                           S.B. 893

(C) WHILE RECEIVING AN ALLOWANCE UNDER THE EMPLOYEES' RETIREMENT
SYSTEM OF THE STATE OF MARYLAND OR THE PENSION SYSTEM FOR EMPLOYEES OF
THE STATE OF MARYLAND, A FORMER EMPLOYEE OR A FORMER EMPLOYEE'S SURVIVING
SPOUSE OR DEPENDENT CHILD:

(1) MAY ENROLL AND PARTICIPATE IN THE HEALTH INSURANCE BENEFIT
OPTIONS ESTABLISHED UNDER THE PROGRAM; AND

(2) EXCEPT AS PROVIDED IN SUBSECTION (D) OF THIS SECTION, IS SUBJECT
TO THE SAME TERMS AND CONDITIONS AS THOSE PROVIDED UNDER § 8-108 OF THIS
SUBTITLE, WITH THE EMPLOYEE'S SERVICE WITH THE MARYLAND ENVIRONMENTAL
SERVICE BEING INCLUDED AS PART OF THE EMPLOYEE'S STATE SERVICE.

(D) FOR EACH PARTICIPANT UNDER THIS SECTION, THE MARYLAND
ENVIRONMENTAL SERVICE SHALL PAY TO THIS STATE AN EMPLOYER SHARE OF THE
COST OF THE PROGRAM BASED ON THE STATE SUBSIDY ALLOWED UNDER THIS
SUBTITLE.

SECTION 3. 4. AND BE IT FURTHER ENACTED, That Section(s)
11-203(a)(1)(xii) through (xv), respectively, of Article - State Finance and Procurement
of the Annotated Code of Maryland be renumbered to be Section(s) 11-203(a)(1)(xi)
through (xiv), respectively.

SECTION 4. 5. AND BE IT FURTHER ENACTED, That all funds in the
Service Reserve Fund on June 30, 1993, shall be paid over to the Service.

SECTION 5. 6. AND BE IT FURTHER ENACTED, That, until January 1, 1995,
the Service shall remit to the State, on a quarterly basis, sufficient funds to pay the
salaries of State employees employed by the Service.

SECTION 6. 7. AND BE IT FURTHER ENACTED, That all persons who are, as
of June 30, 1993, classified or unclassified employees of the Department of Natural
Resources and whose positions are transferred to the Maryland Environmental Service by
this Act are hereby transferred to the Maryland Environmental Service, effective July 1,
1993, without any change or loss of rights or status, and shall retain their merit system and
retirement system status, except as otherwise specifically provided in this Act.

SECTION 7. 8. AND BE IT FURTHER ENACTED, That, except as expressly
provided to the contrary in this Act, any transaction affected by or flowing from any
statute here amended, repealed, or transferred, and validly entered into before July 1,
.1993, and every right, duty, or interest following from it remains valid after July 1, 1993
and may be terminated, completed, consummated, or enforced pursuant to law.

SECTION 8. 9. AND BE IT FURTHER ENACTED, That, except as otherwise
provided in this Act, all rules and regulations, proposed rules and regulations, standards
and guidelines, proposed standards and guidelines, orders and other directives, forms,
plans, memberships, special funds, appropriations, grants, loans, applications and
commitments for grants and loans, contracts, properties, investigations, administrative
and judicial proceedings, rights to sue and be sued, and all other duties and
