(ii) A former employee of the University of Maryland Medical System
Corporation as defined in §§ 13-1B-01 and 13-1C-01 of the Education Article who
receives a retirement allowance from the Employees' Retirement System or the Pension
System for the Employees of the State of Maryland under the provisions of Article 73B,
§§ 10-101 through 10-109, inclusive; OR
(III) A FORMER EMPLOYEE OF THE MARYLAND ENVIRONMENTAL
SERVICE WHO RECEIVES A RETIREMENT ALLOWANCE FROM THE EMPLOYEES'
RETIREMENT SYSTEM OF THE STATE OF MARYLAND OR THE PENSION SYSTEM FOR
EMPLOYEES OF THE STATE OF MARYLAND:
(4) "State service" means:
(i) Service with the State as an employee, judge, teacher, or
correctional officer as defined in Article 73B, §§ 2-101, 3-101, 4-101, 5-101, 6-101,
7-101, and 9-101 of the Code; [or]
(ii) Service as an employee of the University of Maryland Medical
System Corporation as defined in §§ 13-1B-01 and 13-1C-01 of the Education Article
while a member of the Employees' Retirement System or the Pension System for the
Employees of the State of Maryland under the provisions of Article 73B, §§ 10-101
through 10-109, inclusive; OR
(III) SERVICE WITH THE MARYLAND ENVIRONMENTAL SERVICE
WHILE A MEMBER OF THE EMPLOYEES' RETIREMENT SYSTEM OR THE PENSION
SYSTEM FOR THE EMPLOYEES OF THE STATE OF MARYLAND.

(A) THIS SECTION APPLIES TO EMPLOYEES OF THE MARYLAND ENVIRONMENTAL
SERVICE.
(B) AN EMPLOYEE OR, WHILE RECEIVING AN ALLOWANCE UNDER THE
EMPLOYEES' RETIREMENT SYSTEM OF THE STATE OF MARYLAND OR THE PENSION
SYSTEM FOR EMPLOYEES OF THE STATE OF MARYLAND, AN EMPLOYEE'S SURVIVING
SPOUSE:
(1) MAY ENROLL AND PARTICIPATE IN THE STATE EMPLOYEES' HEALTH
INSURANCE PROGRAM; AND
(2) EXCEPT AS PROVIDED IN SUBSECTION (D) OF THIS SECTION, IS SUBJECT
TO THE SAME TERMS AND CONDITIONS UNDER THE PROGRAM AS PROVIDED FOR STATE
EMPLOYEES.
(C) WHILE RECEIVING AN ALLOWANCE UNDER THE EMPLOYEES' RETIREMENT
SYSTEM OF THE STATE OF MARYLAND OR THE PENSION SYSTEM FOR EMPLOYEES OF
THE STATE OF MARYLAND, A FORMER EMPLOYEE OR A FORMER EMPLOYEE'S SURVIVING
SPOUSE OR DEPENDENT CHILD:
(1) MAY ENROLL AND PARTICIPATE IN THE STATE EMPLOYEES' HEALTH
INSURANCE PROGRAM; AND
