SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1993.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 893.

This bill would remove the Maryland Environmental Service as a unit of the Department
of Natural Resources and make it an independent unit of government. It would provide
for the appointment of the Director and Board of Directors of the Service, and increase
the number of members on the Board to nine. This legislation would exempt the Service
from State procurement law but not from Minority Business Enterprise, prevailing wage,
and bonding provisions; and would require that the Service establishes its own
procurement system based on competition through regulations pursuant to the
Administrative Procedure Act.

House Bill 1580, which was passed by the General Assembly and signed by me on April
26, 1993, accomplishes the same purpose. Therefore, it is not necessary for me to sign
Senate Bill 893.

AN ACT concerning

Maryland Environmental Service

FOR the purpose of separating the Maryland Environmental Service from the
Department of Natural Resources and reconstituting the Service as an
instrumentality of the State, and a public corporation; amending the method of
appointment and increasing the number of members of the Board of Directors, and
specifying their terms; amending the duties, responsibilities, and term of the
director of the Service; requiring the Attorney General to assign assistant attorneys
general and other staff to the Service; exempting the Service from certain provisions
of Article 64A of the Code and the State Finance and Procurement Article;
authorizing the Service to establish a personnel system and specifying the rights and
privileges of State employees of the Service as of a certain date; providing for
continuing membership of certain employees of the Service in the Employees'
Retirement System of the State of Maryland or the Pension System for Employees
