Ch. 634                                     1993 LAWS OF MARYLAND

AGAINST ANY PERSON WITH A MENTAL ILLNESS BY FAILING TO PROVIDE HEALTH
CARE BENEFITS AND SERVICES FOR A FOR TREATMENT AND DIAGNOSIS OF MENTAL
ILLNESS UNDER THE SAME TERMS AND CONDITIONS AS PROVIDED FOR ANY OTHER
HEALTH CARE BENEFIT OR SERVICE
THAT THE COMMISSIONER DETERMINES ARE
GENERALLY AVAILABLE UNDER §§ 354 AND 490R OF ARTICLE 48A OF THE CODE.

(2) AN INDIVIDUAL ENROLLEE OR SUBSCRIBER MAY WAIVE ONLY THE
COVERAGE FOR MENTAL ILLNESS PROVIDED UNDER PARAGRAPH (1) OF THIS
SUBSECTION BY MAKING AN AFFIRMATIVE WRITTEN WAIVER ON A FORM SIGNED BY
THAT INDIVIDUAL AND APPROVED BY THE COMMISSIONER. A WAIVER UNDER THIS
PARAGRAPH APPLIES TO EACH DEPENDENT OF THE INDIVIDUAL WHO SIGNS THE
WAIVER.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act may not be
construed to impose any requirements on the benefits to be determined by the Maryland Health
Care Access and Cost Commission to be offered under Article 48A, § 700 of the Code, as
enacted by Chapter
______ (H.B. 1359) of the Acts of the General Assembly of 1993.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall be applicable
to any health insurance contract, policy, certificate, or plan that is issued or renewed on or
after January 1, 1994.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1993 January 1. 1994.

AN ACT concerning

Pensions - Correctional Officers' Retirement System - Service Retirement

FOR the purpose of reducing the years of service needed by certain members of the
Correctional Officers Retirement System for certain service retirement benefits.

BY repealing and reenacting, with amendments,
Article 73B - Pensions
Section 7-401(a)(l)
Annotated Code of Maryland
(1988 Replacement Volume and 1992 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
