(IV) 1 SHALL BE A BOARD MEMBER.

(3)      [The] EXCEPT FOR THE BOARD MEMBER, THE licensed physician
members of the Council shall:

(i) Have engaged regularly in the supervision of acupuncture for at
least 2 years before appointment; and

(ii) Practice medicine or reside in this State at the time of
appointment.

(4)      The acupuncturist members of the Council shall:

(i) Be registered to perform acupuncture;

(ii) Have engaged regularly in the practice of acupuncture for at least
6 years before appointment; and

(iii) Perform acupuncture or reside in this State at the time of
appointment.

(5)      THE CONSUMER MEMBER:

(I)       SHALL BE A MEMBER OF THE GENERAL PUBLIC;

(II)     MAY NOT BE OR EVER HAVE BEEN AN ACUPUNCTURIST, OR
ANY OTHER HEALTH PROFESSIONAL, OR IN TRAINING TO BE AN ACUPUNCTURIST
OR ANY OTHER HEALTH PROFESSIONAL; AND

(III)    MAY NOT HAVE A HOUSEHOLD MEMBER WHO IS AN
ACUPUNCTURIST, OR HEALTH PROFESSIONAL, OR IN TRAINING TO BE AN
ACUPUNCTURIST OR HEALTH PROFESSIONAL.

(K) (1) THE TERM OF A MEMBER IS 4 YEARS, EXCEPT THAT THE INITIAL
TERM OF ONE OF THE CONSUMER MEMBERS IS 3 YEARS.

(2)      AT THE END OF A TERM, A MEMBER CONTINUES TO SERVE UNTIL A
SUCCESSOR IS APPOINTED.

(3)      IF A VACANCY OCCURS AS TO A MEMBER, THE GOVERNOR SHALL
APPOINT A NEW MEMBER TO SERVE ONLY FOR THE REST OF THE TERM AND UNTIL
A SUCCESSOR IS APPOINTED.

(4)      THE GOVERNOR MAY REMOVE A MEMBER FOR INCOMPETENCE OR
MISCONDUCT.

Chapter 502 of the Acts of 1991

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 1993 1991. [It shall remain effective for a period of two years and, at the end of
June 30, 1993, with no further action required by the General Assembly, this Act shall be
abrogated and of no further force and effect.]
