(2) THE PROCESSING OF A CHEMICAL WARFARE MATERIAL OR A
CHEMICAL WEAPON IN ORDER TO REMOVE A COMPOUND, SEPARATE COMPOUND
COMPONENTS, OR OTHERWISE PREPARE A COMPOUND OR COMPONENT FOR

DESTRUCTION, NEUTRALIZATION, TRANSPORTATION, DISMANTLING, OR

DECOMMISSIONING.

7-402. 7-239.2.

(A)     THE STATE OF MARYLAND FINDS THAT THE CHEMICAL WARFARE
MATERIALS AND CHEMICAL WEAPONS SPECIFIED UNDER § 7-401 § 7-239.1 OF THIS
SUBTITLE WERE DESIGNED FOR WARFARE, SPECIFICALLY THE DESTRUCTION OF
HUMAN BEINGS, AND FOR NO LEGITIMATE CIVILIAN INDUSTRIAL USE.

(B)      THE STATE RECOGNIZES THE NEED TO DISPOSE OF THESE CHEMICAL
WARFARE MATERIALS AND WEAPONS AS SAFELY AS POSSIBLE. ENSURING THE
HEALTH AND SAFETY OF STATE RESIDENTS BY THE REGULATION OF THEIR
RELEASE INTO THE ENVIRONMENT AND THE VIGILANT MONITORING AND
REGULATION OF DISPOSAL FACILITY BY
PRODUCTS AND EMISSIONS.

(C)      SINCE THESE CHEMICAL WARFARE MATERIALS AND WEAPONS ARE
HIGHLY TOXIC AND OR CARCINOGENIC AND VERY LITTLE IS KNOWN ABOUT THE
ACUTE OR CHRONIC HEALTH EFFECTS OR THE ENVIRONMENTAL CONSEQUENCES
OF THEIR DESTRUCTION, TREATMENT, OR STORAGE
, IN ADDITION TO ANY OTHER
APPLICABLE REQUIREMENTS AT LAW, THE STATE SHALL REQUIRE WITHOUT
EXEMPTION OR WAIVER THAT AN APPLICANT FOR THE DESTRUCTION, TREATMENT;
OR STORAGE BY INCINERATION OF CHEMICAL WARFARE MATERIALS OR CHEMICAL
WEAPONS
SHALL COMPLY WITH ALL THE REQUIREMENTS OF THIS SUBTITLE AND
ALL REGULATIONS ADOPTED UNDER THE AUTHORITY OF THIS SUBTITLE.

7-403.

(A) EXCEPT AS PROVIDED UNDER SUBSECTION (B) OF THIS SECTION, THE
REQUIREMENTS OF PUBLIC NOTICE AND A PUBLIC HEARING THAT ARE APPLICABLE
TO THE ISSUANCE OF A PERMIT FOR A SOLID WASTE INCINERATOR UNDER § 9 209
OF THIS ARTICLE SHALL APPLY TO THE ISSUANCE OF A PERMIT UNDER THIS
SUBTITLE.

(B) AN APPLICANT FOR A PERMIT UNDER THIS SUBTITLE SHALL GIVE .NOTICE
OF THE APPLICATION AND THE HEARING IN EVERY COUNTY AND MUNICIPAL
CORPORATION INCLUDED IN THE WORST CASE RELEASE UNDER
§ 7-404(A)(4)(II) OF
THIS SUBTITLE.

7-404.

IN ADDITION TO ANY OTHER APPLICABLE REQUIREMENTS, THE DEPARTMENT
MAY NOT ISSUE A PERMIT FOR THE CONSTRUCTION, MATERIAL ALTERATION, OR
OPERATION OF A HAZARDOUS WASTE FACILITY TO BE USED FOR THE
DESTRUCTION, TREATMENT, OR STORAGE OF A CHEMICAL WARFARE MATERIAL OR
A CHEMICAL WEAPON UNLESS:

(1) THE PERMIT APPLICANT DEMONSTRATES:
