(II) BY UTILIZING THE SAME METHOD THAT IT USED TO SELECT
THE PREVIOUS STUDENT MEMBER OF THE BOARD, SELECT ANOTHER STUDENT
MEMBER TO FILL THE VACANCY.

(c)     A Board member who does not maintain the. residency qualification shall be
replaced as a member.

(d)     If the boundary line of a legislative district changes, an incumbent member of
the County Board who, because of the change, no longer resides in the legislative district
from which the member was appointed may complete the term.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October July 1, 1993.

(House Bill 1279)

AN ACT concerning

Agricultural Transfer Tax

FOR the purpose of suspending the requirement for a certain time that a county remit
certain funds to the Maryland Agricultural Land Preservation Fund.

BY repealing and reenacting, without amendments,
Article - Tax - Property
Section 13-306(c)
Annotated Code of Maryland
(1986 Volume and 1992 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Tax - Property

13-306.

(c) If any revenue in the special county account has not been expended or
committed on or before 3 years from the date of deposit into the county account, the
county collector shall remit that revenue to the Comptroller for deposit in the Maryland
Agricultural Land Preservation Fund.

SECTION 2. AND BE IT FURTHER ENACTED, That notwithstanding the
provisions of § 13-306(6) of the Tax - Property Article, for any revenue deposited in a
special county account under § 13-306 on or before June 30, 1990 that has not been
expended or committed, the county collector is not obligated to remit that revenue to the
Comptroller for deposit in the Maryland Agricultural Land Preservation Fund until June
30, 1994.
