Ch. 552                                     1993 LAWS OF MARYLAND

(b)     (1) The Committee consists of 9 members.

(2)     Of the 9 members of the Committee:
(i) 3 shall represent employees;

(ii) 3 shall represent employers; and
(iii)
3 shall be disinterested individuals from the general public.

(3) Subject to paragraph (2) of this subsection, the Committee membership shall
be apportioned geographically over the State.

(4)      The Secretary of Licensing and Regulation shall appoint the members with
the approval of the Governor.

(c)     Before taking office, each appointee to the Committee shall lake the oath required
by Article I, § 9 of the Maryland Constitution.

(d)     (1) The term of a member is 6 years and begins on July 1.

(2)     The terms of members are staggered as required by the terms provided for
members of the Committee on October 1, 1991.

(3)     At the end of a term, a member continues to serve until a successor is
appointed and qualifies.

(4)     A member who is appointed after a term has begun serves only for the rest of
the term and until a successor is appointed and qualifies.

(e)      The Governor may remove a member for incompetence or misconduct.

(f)      From among the members from the general public, the Secretary of Licensing and
Regulation shall appoint a chairman.]

3-410.

[(a)] In addition to any regulation specifically required by this subtitle, regulations that
the Commissioner adopts to carry out this subtitle may include:

(1)     definitions of the terms "administrative capacity", "executive capacity",
"professional capacity", and "outside salesman";
                   

(2)     a scale of wages that is suitable for learners and apprentices but is at least
80% of the minimum wage under this subtitle; and

(3)     a wage for a special case or class of case if the Commissioner finds the wage
appropriate to:

(i) avoid undue hardship;                                       '

(ii) prevent the curtailment of employment opportunity; and

(iii) safeguard the minimum wage under this subtitle.
