AN ACT concerning
Canal Place Preservation and Development Authority
FOR the purpose of establishing a Canal Place Preservation and Development Authority
to create and develop a historic Chesapeake and Ohio Canal preservation district in
the City of Cumberland, Maryland; making certain legislative findings; providing for
the status, composition, and procedures of the Authority and the terms of its
members; authorizing the Authority to appoint an Executive Director; specifying
the duties of the Executive Director; specifying the powers and duties of the
Authority, including the duty to develop a certain management plan for a certain
preservation district in accordance with certain criteria and procedures; providing
for a certain approval of the management plan by the Maryland Historical Trust in
accordance with certain procedures; prohibiting the Authority from making certain
expenditures until certain conditions occur and authorizing the Authority to make
certain other expenditures before those conditions occur; requiring the City of
Cumberland to submit a certain plan to the Authority before the City takes certain
action within a certain area of the preservation district; requiring the Authority to
appoint a certain Task Force; establishing a. Canal Place Preservation and
Development Authority Financing Fund; authorizing the Authority to issue certain
bonds under certain conditions and to take certain actions related to the issuance of
the bonds; exempting the Authority from certain laws; requiring certain actions by
certain units of the State government and prohibiting certain other actions by these
units; authorizing the Board of Public Works to refuse to take certain action
concerning the financial commitments of the Authority under certain
circumstances; requiring the Authority to comply with the State minority business
purchasing law; making any appointee or employee of the Authority subject to the
State Public Ethics Law; authorizing certain employees of the Authority to
participate in the State Pensions System; providing for the construction of this Act;
making provisions of this Act severable; defining certain terms; providing for the
effective date of this Act; and generally relating to the establishment of a Canal Place
Preservation and Development Authority.
BY adding to

Section 13-1001 through 13-1032 13-1031 to be under the new subtitle "Subtitle
10. Canal Place Preservation and Development Authority"
