1993 LAWS OF MARYLAND

(2) SECTION 206 OF THIS ARTICLE PERMITS THE TALBOT COUNTY
COUNCIL TO PROVIDE FOR THE RETAIL ALCOHOLIC BEVERAGE LAWS FOR THE
COUNTY, WHICH, IF ENACTED, SUPERSEDE THE PROVISIONS OF THIS ARTICLE.

[(x)](W) In Washington County [,] the annual license fee is $300.         

[(y)](X) (1) In Wicomico County, any license issued under the provisions of
this section shall be issued only to existing establishments that already have a Class B
beer, wine and liquor (restaurant) license and have been continually operating as a
restaurant in the County for [three] 3 months prior to the application for this license.

(2)     Any license issued under the provisions of this section shall apply only to
the area described in the application and that area may not exceed 20 percent of the area
normally used in the operation of the restaurant business. This area must be contiguous
to and adjoin the restaurant establishment.

(3)     The annual license fee is $2,000. This fee shall be paid in addition to the
fee paid for the Class B (restaurant) license.

(4)     All alcoholic beverages other than beer and light wine shall be
purchased from the Liquor Control Board for Wicomico County and shall be charged not
more than 15 percent above the wholesale operating cost to the dispensary.

[(z)](Y) This section does not apply in Worcester County.

DRAFTER'S NOTE:

This section is revised to clarify language and structure. In addition, standard
language used elsewhere in this piece of legislation speaks to the powers of the Talbot
County Council.

20.

(a)     A Class C beer, wine and liquor license shall be issued by the clerk of the
circuit court of the county in which the place of business is located [, and shall authorize].
IT AUTHORIZES the holder [thereof] to keep for sale and sell all alcoholic beverages at
retail at any club, at the place [therein] described IN THE LICENSE, for consumption on
the premises only[; except in Kent and Queen Anne's Counties where beer may be sold
for consumption off the premises]. The annual fee for [such a] THE license [shall be
two hundred and fifty dollars ($250.00), and] shall be [payable] PAID to [such] THE
clerk[,] before [any such] THE license is issued, for distribution as [hereinafter]
provided.

(b)     (1) THIS SUBSECTION APPLIES ONLY IN [In] Allegany County.

(2)      THE ANNUAL LICENSE FEE IS $450.

(3)      [such beverages] BEVERAGES may be sold for consumption on the
premises or elsewhere[, and the annual fee for such a license is $450].

(c)     (1) THIS SUBSECTION APPLIES ONLY IN [In] Anne Arundel County.
