(III) USE STATE LANDS FOR MITIGATION BANKING.

(2) THE DEPARTMENT MAY ESTABLISH MITIGATION BANKING THROUGH
AND WITH THE COOPERATION OF THE PRIVATE SECTOR AND MAY USE STATE LANDS FOR
MITIGATION BANKING SITES.

SECTION 3. AND BE IT FURTHER ENACTED, That, by December 31, 1993,
the Department of Natural Resources, in conjunction with representatives of the general
public and the business, science, environmental, and development communities, shall
evaluate and report, subject to § 2 1312 of the State Government Article, to the Senate
Economic and Environmental Affairs Committee and the House Environmental Matters
Committee regarding the creation of public and private wetland mitigation banks,
including:

(1) The types of wetlands to be created and the types of wetlands to be filled
for which a person may obtain credit through a mitigation bank;

(2) The types of credits available through the bank to offset each acre of
wetland to be filled;

(3) The types of wetland construction, supervision, and maintenance to be
required of a bank owner seeking to obtain credit for use of the bank; and

(4) The necessity of a panel of experts to review and administratively resolve
disputes regarding the approval, disapproval, or maintenance requirements of a proposed
or existing wetland mitigation bank, and, if applicable, the structure and organization of
the panel, and any legislation recommended for the establishment of this body.

SECTION 1. AND BE IT FURTHER ENACTED, That, based on the report
required under Section 3 of this Act and the recommendations of the Senate Economic
and Environmental Affairs Committee and the House Environmental Matters
Committee, the Department of Natural Resources shall adopt regulations to implement
this Act by July 1, 1994.

SECTION 5. AND BE IT FURTHER ENACTED, That Sections 1 and 2 of this
Act shall take effect July 1, 1991.

SECTION 6. 3. AND BE IT FURTHER ENACTED, That Sections 3 and 1 of
this Act shall take effect July 1, 1993.
