1993 LAWS OF MARYLAND

This section is reorganized to place all counties and Baltimore City in the standard
alphabetical arrangement. The exclusionary subsection, (n), is repealed because each
county is mentioned in the body of the section, with jurisdictions that do not have a Class
A (beer) license so noted.

In reorganizing, a conflict between the provisions of subsection (c) and (n) arose
concerning Anne Arundel County and its Class BP license. In a letter dated June 15,
1992, Anne Arundel County Board of License Commissioners Chairman Thomas E.
Riggin advised that the Class BP license was in error and requested its removal. The Class
BP license in Anne Arundel County is a mistake that occurred in Chapter 614 of the Acts
of 1961.'

In Talbot County, the provisions of section 206 of this article permit the Talbot
County Council to enact retail alcoholic beverage laws for that county; thus, see new
subsection (v). Since Talbot County is not listed among the group of counties to which the
exclusionary section applies and no specific license fee is set forth, the general license fee
($25) applies.

9.

(a) A Class B license shall be issued by the clerk of the circuit court of the county
in which the place of business is located[, and shall authorize the]. THE holder [thereof
to] OF THE LICENSE MAY keep for sale and sell beer at retail at any hotel or restaurant
at the place [therein] described IN THE LICENSE[,] for consumption on the premises or
elsewhere. The annual fee for the license shall be [$50 and shall be payable] PAID to the
clerk[,] before any license is issued, for distribution as [hereinafter] provided.

(B) THIS SECTION DOES NOT APPLY TO ALLEGANY COUNTY.

[(b)](C) [In] THIS SECTION DOES NOT APPLY IN Anne Arundel County [such
license shall be known as Class BR, on sale generally, restaurants, with music, dancing
and other legal entertainment; the annual license fee therefor shall be one hundred and
fifty dollars ($150.00)].

(D)     THIS SECTION DOES NOT APPLY TO BALTIMORE CITY.

(E)     THIS SECTION DOES NOT APPLY TO BALTIMORE COUNTY.

[(c)] (F) In Calvert County the annual license fee [for such a license shall be two
hundred fifty dollars ($250.00)] IS $250.

[(d)](G) In Caroline County the annual license fee is $250.

[(e)] (H) In Carroll County the annual license fee is $130.

[(f)] (I) In Cecil County the annual LICENSE fee [for such a license shall be
seventy-five dollars ($75.00)] IS $75.

(J) THIS SECTION DOES NOT APPLY IN CHARLES COUNTY.

[(b-1)](K) In Dorchester County the annual license fee is $250.

[(g)] (L) In Frederick County the annual license fee is $130.
