AN ACT concerning
Peace Officers - Custody of Arrested Persons
FOR the purpose of authorizing certain peace officers to take, under custody, certain
defendants arrested in other jurisdictions obtain custody of certain persons in the
jurisdiction where they were arrested for purposes of bringing the persons to
District Court commissioners in the jurisdiction in which the charging documents
were issued; affording peace officers the same power to maintain custody of
defendants arrested persons that the peace officers have in the jurisdictions in
which they were appointed; providing for the construction of this Act; and generally
relating to the custody powers of peace officers.
BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 27 - Crimes and Punishments
602C.
(A) Any peace officer in this State, for the purpose of maintaining custody of an
arrested person to bring that person before a District Court commissioner beyond the
boundaries of the jurisdiction for which the peace officer was appointed and in which the
arrest was made, shall have the same power to maintain custody in the jurisdiction in
which the District Court commissioner is located that the peace officer has in the
jurisdiction for which the peace officer was appointed and in which the arrest was made.
(B) (1) A PEACE OFFICER, WHO IS APPOINTED IN THE JURISDICTION
WHERE A CHARGING DOCUMENT IS ISSUED FOR A DEFENDANT PERSON ARRESTED
IN ANOTHER JURISDICTION, MAY BRING THE DEFENDANT UNDER CUSTODY OBTAIN
CUSTODY OF THE ARRESTED PERSON IN THE OTHER JURISDICTION FOR PURPOSES
OF BRINGING THE PERSON BEFORE A DISTRICT COURT COMMISSIONER IN THE
JURISDICTION IN WHICH THE CHARGING DOCUMENT WAS ISSUED.
(2) A PEACE OFFICER HAS THE SAME POWER TO MAINTAIN CUSTODY
OF A DEFENDANT AN ARRESTED PERSON UNDER SUBSECTION (B)(1) OF THIS
SECTION THAT THE PEACE OFFICER HAS IN THE JURISDICTION IN WHICH THE PEACE
OFFICER WAS APPOINTED.
