THE HEALTH INSURANCE BENEFITS AND ELIGIBILITY GUIDELINES THAT ARE
APPLICABLE TO ANY COVERED DEPENDENT SHALL BE MADE AVAILABLE, AT THE
REQUEST OF THE EMPLOYEE OR MEMBER, TO ANY GRANDCHILD WHO:
(1) IS UNMARRIED;
(2) IS IN THE LEGAL COURT-ORDERED CUSTODY OF AND RESIDING
WITH THE EMPLOYEE OR MEMBER; AN©
(3) IS THE DEPENDENT OF THE INSURED OR SUBSCRIBER; AND
(3) (4) HAS NOT ATTAINED THE LIMITING AGE UNDER THE TERMS OF
THE POLICY.
(C) FOR THE PURPOSE OF COVERAGE UNDER THIS SECTION, ANY INSURER
THAT ISSUES AN INDIVIDUAL OR GROUP HEALTH INSURANCE POLICY THAT
PROVIDES COVERAGE ON AN EXPENSE INCURRED BASIS OR ANY NONPROFIT
HEALTH SERVICE PLAN SHALL OFFER, UPON REQUEST, TO ANY INSURED OR
SUBSCRIBER, REGARDLESS OF MARITAL STATUS, FAMILY MEMBERS' COVERAGE.
(D) EVERY INSURER OR NONPROFIT HEALTH SERVICE PLAN THAT ISSUES A
POLICY THAT PROVIDES COVERAGE OTHER THAN FAMILY MEMBERS' COVERAGE
SHALL PROVIDE TO THE POLICYHOLDER A NOTICE THAT COVERAGE FOR
GRANDCHILDREN IS NOT PROVIDED UNDER THE POLICY AND SHALL INFORM THE
POLICYHOLDER OF THE RIGHT AND CONDITIONS TO PURCHASE FAMILY MEMBER
COVERAGE AS PROVIDED UNDER THIS SECTION.
(E) (1) AN INSURER OR NONPROFIT HEALTH SERVICE PLAN UNDER THIS
SECTION MAY:
(I) REQUIRE PROOF THAT THE INSURED OR SUBSCRIBER IS THE
GRANDPARENT OF A GRANDCHILD; AND
(II) PERMIT COVERAGE OF AN INSURED'S OR SUBSCRIBER'S
DEPENDENT CHILD, REGARDLESS OF MARITAL STATUS, OR A MINOR CHILD OF THE
DEPENDENT CHILD.
(2) THE INSURER OR NONPROFIT HEALTH SERVICE PLAN SHALL PAY
THE COST OF PROVIDING THE PROOF REQUIRED UNDER THIS SUBSECTION.

(H) THE PROVISIONS OF ARTICLE 48A, §§ 354, 438A, AND 490R OF THE CODE
SHALL APPLY TO HEALTH MAINTENANCE ORGANIZATIONS.
SECTION 2. AND BE IT FURTHER ENACTED, That all insurers, nonprofit
health service plans, and health maintenance organizations that have delivered before
October 1, 1993 a policy or contract that includes coverage for family members or
dependents shall send written notice to each policyholder by October 1, 1993 of the right
and conditions to purchase coverage for grandchildren as provided in this Act.
