1993 LAWS OF MARYLAND

(3) The Fund shall be administered by the State Board of Victim Services
under §§ 9-1701 through 9-1708 of the State Gov
ernment Article.

SECTION 2. AND BE IT FURTHER ENACTED, That, notwithstanding the
provisions of Article 26A, § 17(e)(3) of the Code; for Fiscal Year 199
4 only, after making
th
e distribution required under Article 26A, § 17(e)(2) of the Code, the Comptroller shall
distribut
e the remainder of the moneys collected from defendants convicted of crimes
und
er Article 27 of the Code or crimes at common law into the General Fund of the
State.

SECTION 3. AND BE IT FURTHER ENACTED, That, subject to Section 2 of
this Act, this Act shall take effect October 1, 1993.
                                                     

Article - Courts and Judicial Proceedings

1-302.1.

(A)     (1) THERE IS ESTABLISHED A JUDICIAL ASSISTANCE FUND IN THE
GENERAL FUND OF THE. STATE;

(2)     THE FUND IS A SPECIAL CONTINUING, NONLAPSING FUND THAT IS
NOT SUBJECT TO § 7-302 OF THE STATE FINANCE AND PROCUREMENT ARTICLE.

(3)     THE TREASURER SHALL SEPARATELY HOLD, AND THE
COMPTROLLER SHALL ACCOUNT FOR, THE FUND.           

(4)     THE FUND SHALL BE INVESTED AND REINVESTED IN THE SAME
MANNER AS OTHER STATE FUNDS.

(5)     ANY INVESTMENT EARNINGS SHALL BE RETAINED TO THE CREDIT
OF THE FUND.

(6)     THE FUND SHALL BE SUBJECT TO AN AUDIT BY THE DIVISION OF
AUDITS AS PROVIDED FOR IN § 2-1215 OF THE STATE GOVERNMENT ARTICLE.

(7) THIS SECTION MAY NOT BE CONSTRUED TO PROHIBIT THE FUND
FROM RECEIVING FUNDS FROM ANY OTHER SOURCE.

(B)     THE JUDICIAL ASSISTANCE FUND SHALL BE USED. TO FUND THE
TEMPORARY ASSIGNMENT OF JUDGES UNDER § 1-302 OF THIS SUBTITLE.

(C)     THIS SECTION SHALL TERMINATE ON OCTOBER 1, 1994.

SECTION 2. AND BE IT FURTHER ENACTED, That, notwithstanding Article
26A, § 17(e)(3) and (4) of the Code, for Fiscal Year 1994, the total amount of fees
deposited into the Maryland Victims of Crime Fund and the Criminal Injuries

Compensation Fund under Article 26A, § 17(e)(3) of the Code may not exceed $2 million.
If the amount of the fees collected und
er Article 26A, § 17(e)(3) of the Code in Fiscal

Year 1994 is more than $2 million, the Comptroller shall deposit the excess fees in the
Judicial Assistance Fund established under § 1-302.1 of the Courts Article. For Fiscal
Y
ear 1994, no portion of the excess fees shall be deposited in the General Fund of the
State.
