(7) A municipal corporation shall notify the. department of any action taken
under paragraph (4) of this subsection on or before [February 1] NOVEMBER 25
preceding the taxable year for which the action is taken;

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1993.

AN ACT concerning

Pensions - Disability Retirement Allowance Offsets - Exception

FOR the purpose of providing for an exception to a requirement to offset a disability
retirement allowance of certain retirees earning over a certain amount from gainful
occupation under certain circumstances; providing for a certain offset to a disability
allowance of certain retirees earning over a certain amount under certain
circumstances; and generally relating to disability retirement allowances from the
Maryland State Retirement and Pension Systems.

BY repealing and reenacting, with amendments,
Article 73B - Pensions.

Section 2-404(f), 3-404(f), 4-404(c)(2), 5-404(c)(2), 6-403(f)(l), 7-404(f), and
8-402(c)(2)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 73B - Pensions

2-404.

(f) (1) (i) In this subsection, "retirement allowance" means the allowance
payable without optional modification as provided in § 2-407 of this subtitle.

(ii) If the medical board reports and certifies to the Board of Trustees
that any ordinary disability retiree under the age of 60 is engaged in or is able to engage
in a gainful occupation paying more than the difference between the retiree's retirement
allowance at the time of the retiree's retirement and the retiree's average final
compensation plus $5,000, and if the Board of Trustees concurs in the report, then the
amount of the retiree's pension shall be reduced.
