SECTION 18. AND BE IT FURTHER ENACTED, That, for fiscal year 1994,
notwithstanding any other provision of law:
(a) The State Board of Education shall withhold a payment of an appropriation
made under budget program 36.01.02.01 (State Share of Basic Current Expenses) in
accordance with the provisions of the Fiscal Year 1994 Budget Bill to require an
agreement under which the implementation of the recommendations of a management
study of Baltimore City schools will be monitored in order to encourage improved
performance.
(b) Any funds withheld by the State Board of Education under the provisions of
this section do not revert to the State General Fund, but shall remain in the General
State School Fund and may only be distributed in accordance with the statutory formula
provisions to the subdivision from which the funds were withheld or in accordance with
other statutory provisions specifically enacted to distribute these funds.
SECTION 18. AND BE IT FURTHER ENACTED, That, for fiscal year 1994,
notwithstanding any other provision of law, any funds collected in accordance with the
provisions of § 17-222 of the State Finance and Procurement Article, relating to liquidated
damages for failure to comply with prevailing wage law, shall be credited to the General Fund
of the State.
SECTION 19. AND BE IT FURTHER ENACTED. That, for fiscal year 1994. the
Governor, when acting under § 7-213 of the State Finance and Procurement Article:
(a) May only reduce appropriations from which funds are distributed under a
statutory formula in a manner which reduces allocations to recipients under the formula
in proportion to distributions made under the formula;
(b) May not reduce the appropriation for the following programs:
(1) The property tax credit program for homeowners established under §
9-104 of the Tax - Property Article;
(2) The property tax relief program for renters established under § 9-102 of
the Tax - Property Article;
(3) The property tax credit program relating to enterprise zones established
under § 9-103 of the Tax - Property Article; and
(4) The subprogram funds for magnet schools budgeted under program
36.01.02.13; and
(4) Any 'Aid to Education" funds (under the 6 digit level budget code 36.01.02)
as appropriated in the fiscal year 1994 Budget Bill, at either the program or subprogram level;
and
(c) May not reduce by more than 25% the targeted local health services funds
budgeted under program 32.06.02.07.
SECTION 20. AND BE IT FURTHER ENACTED, That, notwithstanding any
other provision of law, Program Open Space projects authorized for funding under prior
enactments of the General Assembly in accordance with the provisions of § 5-904 of the
