Ch. 204                                     1993 LAWS OF MARYLAND

(1) "Board" means:

(i) In a county that has one or more community colleges, the board of
community college trustees for the county; or

(ii) Where 2 or more counties establish a region to support a regional
community college, the board of regional community college trustees.

(2)     "Community college" means a community college established under
Title 16 of the Education Article, but does not include the New Community College of
Baltimore Baltimore City Community College.

(3)     "County share" means the total amount of money for operating funds
provided each fiscal year to a board by the county that supports the community college or
colleges or, in the case of a regional community college, the total amount of money for
operating funds provided each fiscal year to the board by all counties that support the
regional community college,

(4)     "State share" means the amount of money for community college
operating funds to be provided each fiscal year to a board by the State,

(b) (1) For fiscal year 1994, in order for a board to receive an increase in the
State share, a county is not required to comply with the maintenance of effort provisions
of § 16-403(c) of the Education Article.

(2) Beginning in fiscal year 1995, the required county share shall be not less
than the fiscal year 1994 county share.

SECTION 16. AND BE IT FURTHER ENACTED, That, notwithstanding any
other provision of law, the failure of a county or Baltimore City to comply with the
expenditure requirements relating to the distribution of State Fire, Rescue, and
Ambulance funds for fiscal years 1992, 1993, or 1994 or 1993 under Article 38A, § 45D §
45D(a)
of the Code, may not result in the withholding of funds with respect to the next
fiscal year by the Secretary of Public Safety and Correctional Services as provided under
that section.

SECTION 17. AND BE IT FURTHER ENACTED, That, for fiscal year 1994,
notwithstanding any other provision of law, the increases in education funding, as
proposed in the fiscal year 1994 State budget as submitted by the Governor, may be
reduced in accordance with the following provisions and with action taken in the Fiscal
Year 1994 Budget Bill:

(a)     For purposes of calculating funding for basic current expenses and the
compensatory education funds program level as provided under § 5-202(b) of the
Education Article, the "per pupil basic current expense figure" as defined under §
5-202(a) of the Education Article shall be $3,177 $3,167 for fiscal year 1994.

(b)     For purposes of calculating funding for transportation grants as provided
under § 5-203 of the Education Article, one-half of the increase provided under
subsection (b) of that section shall not be provided for fiscal year 1994.
