(2)] when the Account balance exceeds [2%] 5% of the estimated General
Fund revenues[;

(3) when the average State unemployment rate is greater than 6.5% for the
period of April through September preceding the General Assembly session in which the
budget is to be considered; or

(4) for fiscal year 1992].

(g) [(1) The] IF AUTHORIZED BY AN ACT OF THE GENERAL ASSEMBLY OR
SPECIFICALLY AUTHORIZED IN THE STATE BUDGET BILL AS ENACTED, THE
Governor may transfer funds from the Account to General Fund revenues [if for the
period of April through September preceding the General Assembly session in which the
budget is to be considered:

(i) the average State unemployment rate was greater than 6.5%; and

(ii) the average State unemployment rate for that period was greater
than the average State unemployment rate for that same period one year earlier.

(2) Notwithstanding the provisions of subsections (h) and (i) of this section,
in fiscal year 1991, the Governor shall transfer $127,400,000 from the Account to the
General Fund"].

(h) If the Governor transfers funds from the Account pursuant to [paragraph
(g)(1)] SUBSECTION (G) of this section, the amount of the transfer from the Account
shall be reduced by an amount equivalent to the reductions made by the General
Assembly in the General Fund appropriations.

(i) Funds of the Account may only be transferred from the Account as provided
in this section and are not subject to transfer by budget amendment.

Article - Tax - Property

13-209.

(a)     The revenue from transfer tax is payable to the Comptroller for deposit in a special
fund.

(b)     (1) The special fund under subsection (a) of this section is used to pay principal
and interest on the bonds issued under the Outdoor Recreation Land Loan of 1969.

(2) For the fiscal year commencing July 1, 1991 and for subsequent fiscal years,
up to 3% of the revenues in the special fund not required under paragraph (1) of this
subsection may be appropriated in the State budget for salaries and related expenses in the
Departments of General Services and Natural Resources and in the Office of Planning
necessary to administer Title 5, Subtitle 9 of the Natural Resources Article (Program Open
Space).

(c)      (1) Subject to subsection (e) of this section, for fiscal years commencing before
July 1, [1995] 1997 the balance of the revenue in the special fund, not required under
subsection (b) of this section, shall be allocated as provided in this subsection.
