BY repealing and reenacting, with amendments,
Article - Education
Section 24-204 and 24-205
Annotated Code of Maryland
(1992 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Education

24-204.

(a)     (1) The Commission [and the State Board of Education] annually shall
[each] prepare a budget request to provide funds to perform [their] ITS duties under
this subtitle.

(2)     The Commission may receive and spend any grant or gift budgeted or
provided for it.

(3)     (i) The Commission is encouraged to make use of its facilities,
equipment, and other resources to provide services that may generate additional income.
Any income earned in that manner shall be considered special funds for use by the
Commission.

(ii) Unexpended funds may be carried forward and expended in any
subsequent fiscal year, subject to the approval of the Board of Public Works.

(b)     (1) The Commission shall have the staff provided in the State budget.

(2)     The secretarial, stenographic, clerical, and custodial employees of the
Commission are members of the classified service under Article 64A of the Code.

(3)     All other employees of the Commission are in the State service but not
in the classified service.

24-205.

(a)     The Commission shall operate a system of State, regional, and local facilities
to provide educational and cultural radio and television programs in this State.

(b)      [The State Board of Education:

(1)     Is] THE COMMISSION, WITH THE APPROVAL OF THE STATE BOARD
OF EDUCATION, IS responsible for and shall control the preparation, content,
SCHEDULING, and programming of all educational television and radio programs used in
the public schools and adult education programs of this State[; and

(2)     Has priority as to scheduling of television and radio programs during
school hours],
