1993 LAWS OF MARYLAND

FOR the purpose of extending a certain termination date applicable to the Operating
Assistance Grants Demonstration Projects program administered by the
Department of Housing and Community Development; reducing the term of certain
types of operating assistance grants; modifying provisions regarding the maximum
amount of grants made during a fiscal year; removing a reporting requirement; and
generally relating to the Department of Housing and Community Development and
operating assistance grants demonstration projects.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 83B - Department of Housing and Community Development

2-1204.

(a)     Operating assistance grants made under this subtitle may not exceed amounts
established by the Department and may be calculated as:

(1)     A fixed lump sum;

(2)     A percentage of the costs of undertaking a project; or

(3)     A percentage of the amount of the loan, if any, being financed by the
Department.

(b)     A nonprofit organization may receive only 1 operating assistance grant for
capacity building purposes under § 2-1202 of this subtitle.               

(c)     A grant made under § 2-1202 of this subtitle may be for a term [of 3] NOT TO
EXCEED 2 years if, in the determination of the Department, the performance of the

' nonprofit organization in the first year is acceptable and funds are appropriated and
available in the succeeding years.

(d)     During any fiscal year, the total amount of all operating assistance grants
made under this subtitle shall be made from, and may not exceed[,] 1 percent of the
TOTAL AGGREGATE AMOUNT OF budgeted moneys in the[:

(1)] Rental Housing Programs Fund [in the case of grants made in relation
to programs or activities that are operated with moneys in that Fund;

(2)] Homeownership Programs Fund [in the case of grants made in relation
to programs or activities that are operated with moneys in that Fund;], and

[(3)] Special Loan Programs Fund [in the case of grants made in relation to
programs or activities that are operated with moneys in that Fund].
