(ii) Has not practiced actively physical therapy or limited physical
therapy in this State during that period;

(iii) Otherwise is entitled to be licensed;

(iv) Pays to the Board the application fee set by the Board; [and]

(v) Submits to the Board an application on the form required by the
Board; AND

(VI) HAS MET THE CONTINUING EDUCATION REQUIREMENTS OF §
13-311(D) OF THIS SUBTITLE.

(2) The Board may not require the physical therapist or physical therapist
assistant who qualifies for reinstatement under this subsection to be reexamined under §
13-306 of this subtitle.

A person who violates any provision of this title is guilty of a misdemeanor and on
conviction is subject to a fine not exceeding $1,000.]

IF, AFTER A HEARING UNDER § 13-317 OF THIS TITLE, THE BOARD FINDS THAT
THERE ARE GROUNDS UNDER § 13-316 OF THIS TITLE TO SUSPEND OR REVOKE A
LICENSE TO PRACTICE PHYSICAL THERAPY OF OR LIMITED PHYSICAL THERAPY, TO
REPRIMAND A LICENSEE, OR TO REFUSE TO LICENSE AN APPLICANT, THE BOARD
MAY IMPOSE A PENALTY NOT EXCEEDING $5,000:

(1) INSTEAD OF SUSPENDING THE LICENSE; OR

(2) IN ADDITION TO SUSPENDING OR REVOKING THE LICENSE OR
REPRIMANDING THE LICENSEE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1993.

State Board of Electrologists

FOR the purpose of altering certain fees relating to reexamination and licensure by the
State Board of Electrologists; repealing the termination date relating to educational
requirements for electrology; providing for the effective date of this Act; and
generally relating to the State Board of Electrologists.
