Ch. 73                                       1993 LAWS OF MARYLAND

(1)    No funds may be expended until the project has an approved
program and an environmental impact statement has been completed;

(2)    An equal and matching fund be provided from private
contributions; and

(3)     The State expenditure does not exceed the lesser of one-half of
the actual design cost of the project or this appropriation
...................

It is the intent of the General Assembly that no further State funds,
capital or operating, be provided for this project and that once
completed, the center be privately operated.

It is further the intent of the General Assembly that the operators of the
center and any private foundations connected with the operation of the
center be subject to periodic audits to be performed by the Legislative
Auditor.

30.01.09                    MARYLAND ENVIRONMENTAL SERVICE

(A) Water and Wastewater Facilities Improvement Fund. Provide
funds to design, construct, and equip capital improvements for
State institutions. Notwithstanding any provision of State law to
the contrary including, but not limited to, the procurement
provisions of the State Finance and Procurement Article, and
subject to approval of the Board of Public Works, the Maryland
Environmental Service shall be responsible for and control
procurement of equipment, construction, engineering and
architectural services, and all related services and supplies for
projects and public improvements for which State funds are hereby
appropriated to the Maryland Environmental Service.
Expenditures for any of the following projects may not exceed the
amount listed below for that project by more than 7.5% without
notification to the General Assembly. Expenditure of any part of
this appropriation for a project not listed below shall also require
notification to the General Assembly................................................

Gathland and Washington Monument State Parks (Frederick and
Washington Counties):

Construct improvements to water distribution systems..260,000

Jessup Correctional Complex (Anne Arundel County):

Upgrade water service...................................................1,057,000

Design and construct improvements to sewer service....235,000

Hagerstown Correctional Complex (Washington County):

Design and construct improvements to water distribution
system................................................................................985,000

Poplar Hill Pre-Release Unit (Wicomico County):

Design improvements to wastewater treatment plant......52,000
