CHAPTER 58
(House Bill 868)

AN ACT concerning

State Board of Examiners of Professional Counselors

FOR the purpose of continuing the State Board of Examiners of Professional Counselors
(Board) in accordance with the Program Evaluation Act by extending to a certain
date the termination provision relating to the statutory and regulatory authority of
the Board and the regulation of professional counselors; authorizing the Board to
set certain fees; requiring the examination to include a certain portion; requiring
certain persons to complete a certain examination by a certain date; limiting the
number
prohibiting the use of home study hours that may be counted towards
completion of certain continuing education requirements; providing a certain
exception;
and generally relating to the State Board of Examiners of Professional
Counselors and the regulation of professional counselors.

BY repealing and reenacting, with amendments,

Section 17-206(b), 17-304, 17-306, 17-309, and 17-502
Annotated Code of Maryland
(1991 Replacement Volume and 1992 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health Occupations

17-206.

(b) (1) The Board may set reasonable fees for the issuance and renewal of
certificates and its other services, INCLUDING THE MAINTENANCE OF LETTERS OF
INTENT IN ACCORDANCE WITH THE PROVISIONS OF § 17-306 OF THIS TITLE.

(2)     The fees charged shall be set to produce funds so as to approximate the
cost of maintaining the Board.

(3)     Funds to cover the expenses of the Board members shall be generated by
fees set under this section.

17-304.

(a)     An applicant who otherwise qualifies for a certificate is entitled to be
examined as provided in this section.

(b)     The Board shall give examinations to applicants at least twice a year, at the
times and places that the Board determines.

(c)     The Board shall notify each qualified applicant of the time and place of
examination.
