3-305. EXAMINATIONS.

(A)  RIGHT TO EXAMINATION.

AN APPLICANT WHO OTHERWISE QUALIFIES FOR A LICENSE IS
ENTITLED TO BE EXAMINED AS PROVIDED IN THIS SECTION.

(B)  TIME AND PLACE OF EXAMINATION.

THE BOARD SHALL GIVE EXAMINATIONS TO APPLICANTS AT LEAST
ONCE A YEAR AT THE TIME AND PLACE THAT THE BOARD DETERMINES.

(C)  NOTICE OF EXAMINATION.

THE BOARD SHALL GIVE EACH QUALIFIED APPLICANT NOTICE OF THE
TIME AND PLACE OF EXAMINATION.

(D)  SUBJECTS AND METHOD OF EXAMINATION.

(1)  THE BOARD SHALL DETERMINE THE SUBJECTS, SCOPE,
AND FORM OF AND THE PASSING SCORE FOR EXAMINATIONS GIVEN UNDER
THIS TITLE.

(2)  THE BOARD MAY ADOPT AN EXAMINATION OR A
RECOMMENDED GRADING PROCEDURE OF THE COUNCIL OR ANY SIMILAR
ORGANIZATION.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from the
first clause of the first sentence of former Art. 56,
§ 468(b).

Subsection (b) of this section is new language derived
without substantive change from the first sentence of
former Art. 56, § 466(d).

Subsection (c) of this section is standard language
added to conform to the practice of the Board and to
other similar provisions elsewhere in this article.
It provides an element of fundamental fairness by
requiring the Board to give qualified applicants
notice before the administration of examinations.

Subsection (d) of this section is new language derived
without substantive change from the second and third
sentences of former Art. 56, § 468(b).
