LAWS OF MARYLAND

THIS TITLE DOES NOT REQUIRE A PERSON TO EMPLOY A LICENSED
ARCHITECT IN CONNECTION WITH ANY ALTERATION, CONSTRUCTION,
DESIGN, OR REPAIR OF A BUILDING OR OTHER STRUCTURE OF THAT
PERSON.

(B) RIGHTS NOT LIMITED.

THIS TITLE DOES NOT LIMIT THE RIGHT OF:

(1)  AN INDIVIDUAL TO PERFORM ARCHITECTURAL SERVICES
INCIDENTALLY TO PRACTICING ENGINEERING, IF THE INDIVIDUAL IS
LICENSED OR OTHERWISE AUTHORIZED UNDER TITLE 14 OF THIS ARTICLE
TO PRACTICE ENGINEERING;

(2)  AN INDIVIDUAL TO PERFORM ARCHITECTURAL SERVICES
INCIDENTALLY TO PRACTICING LANDSCAPE ARCHITECTURE, IF THE
INDIVIDUAL IS LICENSED OR OTHERWISE AUTHORIZED UNDER TITLE 9 OF
THIS ARTICLE TO PRACTICE LANDSCAPE ARCHITECTURE;

(3)  A REAL ESTATE BROKER, ASSOCIATE REAL ESTATE
BROKER, OR REAL ESTATE SALESPERSON TO APPRAISE PROPERTY OR TO
CHOOSE SITES; OR

(4)  A CONSTRUCTION CONTRACTOR TO ADMINISTER
CONSTRUCTION CONTRACTS.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from
former Art. 56, § 471.

Subsection (b) of this section is new language derived
without substantive change from the introductory
sentence and the first clauses of items (1) through
(3) and (5) of former Art. 56, § 469.

In subsection (a) of this section, the phrase "of that
person" is added to clarify that the exemption applies
only in connection with a structure owned by that
person. The Business Occupations Article Review
Committee notes, for consideration by the General
Assembly, that this addition is intended to clarify
the meaning of the somewhat ambiguous former Art. 56,
§ 471. Read literally, that former section could be
interpreted to provide that a person need not employ a
licensed architect in connection with any alteration,
construction, design, or repair of any structure.
This addition is based on the Committee's
understanding of the intended meaning of former Art.
56, § 471. Despite this addition, the Committee still
is concerned about the application of subsection (a)
of this section, because it could allow the design of
a structure that is intended for public use by a
person who is not qualified to practice architecture.
