REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, § 342.

This section is revised to apply to practicing
property line surveying while a license to practice
that profession is suspended or revoked.

In the introductory language of this section, the
former reference to a refusal "to renew" a license is
deleted to conform to the referenced § 15-318 of this
title. See the revisor's note to that section.

In item (2) of this section, the reference to a
"partnership" is substituted for the former reference
to a "firm" to conform to § 15-401 of this title.

15-609. PRACTICING WHILE NOT QUALIFIED.

(A)  LAND SURVEYING.

AN INDIVIDUAL WHO IS AUTHORIZED TO PRACTICE LAND   SURVEYING

MAY NOT PRACTICE OR OFFER TO PRACTICE LAND SURVEYING     IN THOSE

AREAS OF LAND SURVEYING IN WHICH THE INDIVIDUAL IS NOT  COMPETENT
TO PRACTICE.

(B)  PROPERTY LINE SURVEYING.

AN INDIVIDUAL WHO IS AUTHORIZED TO PRACTICE PROPERTY LINE

SURVEYING MAY NOT PRACTICE OR OFFER TO PRACTICE PROPERTY LINE

SURVEYING IN THOSE AREAS OF PROPERTY LINE SURVEYING IN WHICH THE
INDIVIDUAL IS NOT COMPETENT TO PRACTICE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, §
343(a)(7).

The Business Occupations Article Review Committee
notes, for consideration by the General Assembly, that
the meaning of former Art. 56, § 343(a)(7) is unclear.
The Committee has interpreted the former prohibition
against practicing "when not qualified" to refer to an
individual who, while authorized to practice land
surveying or property line surveying, undertakes a
project that is outside the individual's area of
professional competence. The Board and the Office of
the Attorney General concur with this interpretation.
