WILLIAM DONALD SCHAEFER, Governor
Ch. 3
The second sentence of former Art. 75 1/2, § 10, which
provided that records of the Board are prima facie
evidence and that certified copies are admissible in
evidence, is deleted as unnecessary in light of the
provisions on admissibility in CJ § 10-204.
Defined terms: "Board" § 14-101
"License" § 14-101
14-209. ESTABLISHMENT OF FEES; DISPOSITION OF MONEY.
(A) ESTABLISHMENT OF FEES.
EXCEPT FOR THE FEES SPECIFICALLY SET BY THIS TITLE, THE
BOARD MAY SET THE FEES FOR WHICH THIS TITLE PROVIDES FOR THE
ISSUANCE AND RENEWAL OF LICENSES AND ITS OTHER SERVICES.
(B) DISPOSITION OF MONEY.
EXCEPT AS OTHERWISE PROVIDED BY LAW, THE BOARD SHALL PAY ALL
MONEY COLLECTED UNDER THIS TITLE INTO THE GENERAL FUND OF THE
STATE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the first sentence of
former Art. 75 1/2, § 8(a), as that sentence related
to the establishment of fees, and the first sentence
of § 9, as that sentence related to crediting fees to
the State Treasurer.
The introductory language of subsection (b) of this
section, "[e]xcept as otherwise provided by law", is
added in light of the provisions for the Licensing
Testing Fund under Art. 41, § 8-104(g)(2) of the Code.
In subsection (b) of this section, the reference to
the "General Fund" is substituted for the broader
reference to the "State Treasurer", for clarity.
The second sentence of former Art. 75 1/2, § 9, which
provided for the disbursement of appropriations in the
State budget, is deleted as superfluous and
potentially misleading. Disbursement of money for all
of the boards under the Department is made under the
budget of the Department. The procedure for
disbursement is uniform for all of the boards.
Defined terms: "Board" § 14-101
"License" § 14-101
14-210. JUDICIAL REVIEW.
