PROCEEDINGS OF THE BOARD; AND

FOR

THE

CONDUCT OF THE

(II) ANY REGULATION TO CARRY OUT THIS TITLE,
SUBJECT TO THE LIMITATION UNDER PARAGRAPH (2) OF THIS SUBSECTION.

(2) THE BOARD MAY NOT ADOPT ANY REGULATION THAT WOULD
RESTRICT OR OTHERWISE WOULD AFFECT COMPETITIVE BIDDING FOR
ENGINEERING SERVICES.

(B) DUTIES.

IN ADDITION TO ANY DUTIES SET FORTH ELSEWHERE, THE BOARD
SHALL:

TITLE.

(1)  ADMINISTER THIS TITLE;

(2)  ADOPT A SEAL;

(3)  KEEP A RECORD OF ITS PROCEEDINGS; AND

(4)  KEEP A FILE ON EACH APPLICANT FOR:

(I)  A LICENSE; AND

(II)  CERTIFICATION UNDER § 14-310 OF THIS

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 75 1/2, §
3(b), § 8(b)(2), the first clause of (c), and, except
as it related to fees, the first sentence of (a), and
the first sentence of § 10.

The introductory phrases of subsections (a) and (b) of
this section, "[i]n addition to any [powers or duties]
set forth elsewhere", are added to clarify that the
enumerated powers and duties are not exhaustive.

In subsection (a)(1) of this section, the former words
"reasonably necessary" are deleted as unnecessary in
light of the word "may". In any event, the Secretary
has general supervisory responsibility over the
exercise of powers, § 14-211 of this subtitle, but
particularly over rulemaking. See Art. 41, §§ 1-202
and 8-104(b) of the Code.

In subsection (a)(l)(i) of this section, the reference
to "bylaws" reflects that throughout the Health
Occupations Article and this article, the power to
adopt regulations for the conduct of the proceedings
of a board is expressed in terms of adoption of
bylaws.
