SOMERSET

WHEREAS, the existing charter of the Town of Somerset makes
no provision for the recall of the Mayor or Town Council members;
and

WHEREAS, the Town Council believes that a recall procedure
would be desirable and that the procedures should be similar to
the referendum procedures in Section 83-11; and

WHEREAS, to accommodate this provision, the Charter
Amendment would add a new Section 83-11A to the Charter.

CHARTER AMENDMENT NO. 4-88

RESOLUTION TO AMEND TOWN CHARTER

TO PROVIDE FOR ELECTION OF

NEW TOWN OFFICIALS AFTER A RECALL ELECTION

WHEREAS, Section 3 of Article XI-E of the Constitution of
Maryland authorizes a municipal corporation to amend its charter
relating to its organization, government and affairs; and

WHEREAS, on December 5, 1988, the Town Council passed a
resolution amending the charter to create a new section 83-11A,
which section will set forth procedures for the recall of elected
officials; and

WHEREAS, section 83-34 of the charter currently has
procedures for appointment or election of public officials if
there is a vacancy; and

WHEREAS, the council believes that section 83-34 should be
amended to contain specific provisions regarding election of
public officials if there is a vacancy due to a recall election.
