WILLIAM DONALD SCHAEFER, Governor

Ch. 3

(B) PILOT TO PRESENT REGULATIONS.

WHENEVER A LICENSED PILOT BOARDS A VESSEL TO     PROVIDE

PILOTAGE, THE LICENSED PILOT SHALL PRESENT TO THE MASTER    OF THE

VESSEL A COPY OF THE STATE REGULATIONS THAT GOVERN THE  DISPOSAL
OF WASTE FROM VESSELS IN THE CHESAPEAKE BAY.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first sentence of
former Art. 74, § 12A.

In subsections (a) and (b) of this section, the word
"State" is added to modify the word "regulations", to
clarify the scope of this duty.

Also in subsections (a) and (b) of this section, the
term "vessel" is substituted for the former term
"ship[s]", to conform to terminology used throughout
this title.

In subsection (a) of this section, the reference to
the "Water Resources Administration" is substituted
for the former obsolete name "Department of Water
Resources", in accordance with Ch. 348, § 4, Acts of
1972. However, the Business Occupations Article
Review Committee notes, for consideration by the
General Assembly, that, in light of the creation of
the Department of the Environment by Ch. 306, Acts of
1987, for the purposes of consolidating environmental
regulatory programs in a single cabinet-level agency
and expediting the recovery of the Chesapeake Bay, the
General Assembly may want to transfer the
responsibility for printing regulations under this
section to the Department of the Environment.

In subsection (b) of this section, the phrase "to
provide pilotage" is added to clarify when a licensed
pilot must comply with the duty.

Defined terms: "Licensed pilot" § 11-101
"Provide pilotage" § 11-101

11-602. PAYMENTS FOR DETAINING PILOT OR CARRYING PILOT TO SEA.

(A)  DETAINING PILOT.

IF A LICENSED PILOT   IS DETAINED FOR ANY REASON ON A VESSEL

THAT HAS EMPLOYED THE   PILOT TO PROVIDE PILOTAGE, THE MASTER OF

THE VESSEL SHALL PAY THE  COST OF THE PILOT'S MAINTENANCE AND $75

PER DAY FOR EACH DAY THE   PILOT IS DETAINED.

(B)  QUARANTINED PILOT.
