SUBTITLE 4. LICENSING.

11-401. LICENSE REQUIRED.

(A)  IN GENERAL.

EXCEPT AS OTHERWISE PROVIDED IN THIS SUBTITLE, AN INDIVIDUAL
SHALL BE LICENSED BY THE BOARD BEFORE THE INDIVIDUAL MAY PROVIDE
PILOTAGE IN THE STATE.

(B)  EXCEPTION.

AN INDIVIDUAL MAY PROVIDE PILOTAGE TO A VESSEL IN DISTRESS
UNTIL A LICENSED PILOT COMES ON BOARD AND OFFERS TO PROVIDE
PILOTAGE.

(C)  LIABILITY.

A PERSON WHO PROVIDES PILOTAGE WITHOUT A LICENSE IS LIABLE
FOR ANY DAMAGES THAT RESULT.

REVISOR'S NOTE: Subsection (a) of this section is derived
without substantive change from former Art. 74, § 4(a)
and the first sentence of § 6 and rephrased in
standard language to state affirmatively that an
individual must be licensed to provide pilotage. See
also § 11-701 of this title.

Subsections (b) and (c) of this section are new
language derived without substantive change from the
second sentence of former Art. 74, § 6, except as that
sentence related to the forfeiture by a person who
provides pilotage without a license and the fees for
pilotage under the exception.

In subsection (a) of this section, the former word
"branch" is deleted as obsolete and unnecessary in
light of the term "licensed".

In subsection (c) of this section, the former detailed
reference to piloting any vessel over certain waters
and to certain destinations is deleted for clarity,
brevity, and uniformity.
