11-208. AUTHORITY OF SECRETARY.

THE BOARD EXERCISES ITS POWERS, DUTIES, AND FUNCTIONS
SUBJECT TO THE AUTHORITY OF THE SECRETARY.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 74, §
1(f).

The former reference that narrowly limited the
Secretary's authority to the powers and duties of the
Board "vested ... by the provisions of this title" is
deleted as misleading. Presumably, the powers and
duties of the Board wherever codified are to be
subject to the authority of the Secretary.

As to the authority of the Secretary, see, in
particular, Art. 41, §§ 8-101 through 8-106 of the
Code.

SUBTITLE 3. APPRENTICE PILOTS.

11-301. APPOINTMENT REQUIRED.

AN INDIVIDUAL SHALL BE APPOINTED BY THE BOARD BEFORE THE
INDIVIDUAL MAY SERVE AS AN APPRENTICE PILOT.

REVISOR'S NOTE: This section is new language added to state
a fundamental prerequisite implicit throughout the
former provisions of Art. 74 that related to serving
as an apprentice pilot.

It is stated in language comparable to the standard
language that is used to state affirmatively that an
individual must be licensed to engage in a regulated
practice.

"Board" § 11-101

11-302. LIST OF APPLICANTS QUALIFIED FOR APPRENTICESHIP.

THE BOARD SHALL KEEP A LIST OF ALL APPLICANTS WHO QUALIFY TO
BE APPRENTICE PILOTS.

REVISOR'S NOTE: This section is new language added to state
expressly that which only was implied by former Art.
