involving land clearing on forest lands shall consult with the
Department to assure compliance with this section:

(1) (I) Before cutting in or clearing a forest; and

(2) (II) Before locating a reforestation area in
accordance with this section.

(2) THE PROVISIONS OF THIS SUBSECTION ALSO SHALL
APPLY TO ANY CONSTRUCTION PROJECT BY ANY OTHER PERSON WHO USES
STATE FUNDING FOR THAT PROJECT.

(G) THE PROVISIONS OF THIS SECTION DO NOT APPLY TO ANY
AGRICULTURE PRACTICES IMPLEMENTED UNDER A SOIL AND WATER
CONSERVATION PLAN.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1989.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed Senate Bill 556.

This bill increases the maximum rates of compensation for members
of the Property Tax Assessment Appeal Boards. Specifically, it
requires that the hourly rate be raised from $20 to $25 and the
daily rate from $120 to $150.

I realize that the members of the local Boards perform an
invaluable public service by hearing the numerous appeals filed
in matters relating to the value of property. I appreciate their
dedication and the hard work that is required to perform this
important job. Although I recognize that the amount of time
required to carry out these responsibilities varies greatly among
the counties, I tend to believe that the current member's
decision to serve was not based upon the rate of pay. In light
of that, I do not believe that a salary increase is necessary at
this time.
