select the individual whose qualifications will most closely meet
the needs of a particular jurisdiction and the State as a whole.
Furthermore, the requirement for multiple nominations ensures the
broadest opportunity for public participation in seeking
appointed office.

While I recognize that a few local jurisdictions have been unable
to persuade at least 3 individuals to allow their names to be
nominated for Board service, the majority of the counties appear
to have no problem in complying with the current law. In
addition, my Appointments Secretary has consistently cooperated
with jurisdictions that have had recruitment difficulties,
provided that a "good faith" effort was made to comply with the
law.

Since I believe that the current procedure works well and
preserves my ability and discretion to appoint the individual
whom I deem most qualified, I have vetoed Senate Bill 497.

AN ACT concerning

Property Tax Assessment Appeal Board
Members - Appointment

FOR the purpose of repealing a requirement that a list of names
of potential property tax assessment appeal board members
submitted by a local jurisdiction to the Governor contain a
certain number of names.

BY repealing and reenacting, with amendments,

Article - Tax - Property
Section 3-103(a)
Annotated Code of Maryland
(1986 Volume and 1988 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
