Ch. 831                                       LAWS OF MARYLAND

(d)(1)(i) Except as provided in paragraph (2) of this

subsection, an amendment under this section may not increase a

salary so that it exceeds the amount set by the most recently
enacted State budget.

(ii) The limitation in this paragraph applies
whether or not the most recently enacted budget is in effect.

(2) (i) [The Governor may approve an amendment that
increases the salary indicated in the most recently enacted
budget bill whether or not the bill is in effect for a
nonclassified position listed in the budget bill in accordance
with § 7-109 if:

1.  the Board of Public Works has approved
the increase in accordance with Article 64A, § 27(a) of the Code;
and

2.  compliance with Article 64A, § 27(a)
of the Code is documented.

(ii) The Governor may approve an amendment that
increases the salary for any position other than a nonclassified
position listed in the budget bill in accordance with § 7-109 if
the Board of Public Works has approved the increase in accordance
with Article 64A, § 27(a) of the Code or as authorized by the
Department of Personnel.] IF THE BOARD OF PUBLIC WORKS APPROVES
THE INCREASE, THE GOVERNOR MAY APPROVE AN AMENDMENT THAT
INCREASES THE SALARY FOR A POSITION LISTED IN THE BUDGET BILL IN
ACCORDANCE WITH § 7-109 OF THIS TITLE.

[(iii)] (II) An amendment under this paragraph
remains effective until the State budget for the next fiscal year
becomes effective.

Article - Transportation

4-205.

(d) (1) Subject to paragraph (2) of this subsection, the
Authority may employ [and fix the compensation of] attorneys,
consulting engineers, accountants, construction and financial
experts, superintendents, managers, and any other agents and
employees that it considers necessary to exercise its powers and
perform its duties. THE COMPENSATION ESTABLISHED BY THE
AUTHORITY FOR EXECUTIVE MANAGEMENT POSITIONS SHALL BE CONSISTENT
WITH THE COMPENSATION OF COMPARABLE POSITIONS IN THE DEPARTMENT
OF TRANSPORTATION. THE COMPENSATION ESTABLISHED BY THE AUTHORITY
SHALL BE REPORTED TO THE GENERAL ASSEMBLY EACH YEAR AS PART OF
THE AUTHORITY'S PRESENTATION OF ITS BUDGET.
