CHAPTER 824

(House Bill 1308)

AN ACT concerning

Controlled Dangerous Substance and Alcohol
Testing Laboratories - Applicable Parties

FOR the purpose of requiring certain employers to provide certain
information to certain persons who test positive for the use
or abuse of any controlled dangerous substance or alcohol;
specifying certain requirements as to the notification;
specifying that contractors or certain other persons may
also request independent testing of certain samples for
verification of certain test results; clarifying that
existing provisions of law requiring certification of
laboratories that perform job-related alcohol and controlled
dangerous substance testing for employers apply to testing
of all persons, including employees, preemployment
applicants, and contractors; prohibiting a laboratory,
physician, or other person who obtains information on
certain drug use, excluding alcohol, through job-related
drug or alcohol testing from revealing certain information
to the employer for whom the test is being performed;

requiring the Department of Health and Mental Hygiene to
adopt regulations requiring certain laboratories to be
inspected and accredited by a certain organization; and
generally relating to controlled dangerous substance and
alcohol testing.
