(c)  Before the Department may issue to a person a new tidal
fish license, the person must:

(1)  Register with the Department on a form provided
by the Department at least 2 years before the year of license
issuance;

(2)  Pay all applicable tidal fish license fees set
under § 4-701 of this subtitle at the time of registration; and

(3)  Apply with the Department only during the months
of July and August of any year.

(d)  An applicant is not required to pass a test to obtain a
new tidal fish license under this section.

SECTION 2. AND BE IT FURTHER ENACTED, That notwithstanding
§ 4-703(b) and (c) of the Natural Resources Article, the
Department may issue a new license to a person who held a valid
tidal fish license for the license year ending August 31, 1988
and who did not renew that license prior to September 1, 1988 if
the Department of Natural Resources determines that:

(1)  An undue economic hardship would be placed on the
person;

(2)  The person relied on erroneous or misleading
information; or

(3)  An extraordinary circumstance prevented the
person from submitting a timely application.

SECTION 2. 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1989.

SECTION 4. AND BE IT FURTHER ENACTED, That Section 2 of
this Act shall remain effective for a period of 2 months and, at
the end of August 31, 1989, and with no further action required
by the General Assembly, Section 2 of this Act shall be abrogated
and of no further force and effect.
