waterfowl stamp for a fee of $6 from the clerk of the circuit
court of any county or from any person designated by the
Department. The issuing clerk or person designated shall retain
the sum of 10 cents as compensation for issuing each stamp. The
balance of the fee is paid over and accounted for to the State
Treasurer. The Treasurer shall credit all such fees received to
the State Wildlife Management and Protection Fund, in accordance
with § 10-209 of this title.
(2) The Department may sell expired stamps below face
value to the general public for a period of 3 years, after which
time the Department shall shred any unsold expired stamps. All
revenues derived from the sale of these stamps shall revert back
to the Game Management Fund.
(3) A STATE RESIDENT WHO IS OVER THE AGE OF 64 YEARS
IS EXEMPT FROM PAYING THE FEE REQUIRED UNDER PARAGRAPH (1) OF
THIS SUBSECTION. HOWEVER, THE STATE RESIDENT SHALL COMPLY WITH
ALL OF THE OTHER REQUIREMENTS OF THIS SECTION, INCLUDING THE
REQUIREMENT THAT A MARYLAND MIGRATORY WILD WATERFOWL STAMP BE
OBTAINED, BEFORE HUNTING MIGRATORY WILD WATERFOWL IN THE STATE.
(d) The Maryland migratory wild waterfowl stamp shall be
fixed adhesively in the manner that the Department provides on
the consolidated hunting license or basic hunting license of the
person to whom the stamp is issued. The recipient shall sign the
stamp in ink.
(e) (1) All revenues accruing to the Wildlife Management
and Protection Fund from sales of the migratory wild waterfowl
stamps shall be expended solely for the following purposes:
(i) 50 percent for propagation, purchase,
distribution of hand reared ducks, and operation of hatchery
facilities; and
(ii) '50 percent for waterfowl projects included
in an approved State program to create, develop, maintain,
manage, preserve, and enhance waterfowl habitat on public lands.
(2) Under the program established by this subsection,
a duck may not be released under the age of 6 weeks.
(3) To encourage waterfowl habitat conservation on
private lands, the Department shall implement a 10 year licensing
agreement for approved projects on privately owned lands
detailing the landowner's responsibilities. Expenditures by
private landowners on private land for these waterfowl projects
approved by the Department and covered by the licensing agreement
shall be considered a contribution to the State.
(4) The Governor shall appoint an advisory committee
of 13 members composed of nine members who have a practical
