AN ACT concerning
Alcohol and Drug Abuse - Intoxicated
Individuals - Evaluation and Treatment
FOR the purpose of authorizing the Alcohol and Drug Abuse
Administration to adopt certain regulations relating to the
evaluation and treatment of intoxicated individuals;
establishing the circumstances under which certain personnel
may take an intoxicated individual to the individual's home,
a detoxification center, or a health care facility;
establishing certain procedures for the admission of an
individual to a detoxification center or a health care
facility; clarifying the authority of a judge to order the
Department of Health and Mental Hygiene to conduct an
evaluation of a defendant; authorizing certain judges to
establish certain conditions for the performance of an
evaluation; clarifying the authority of a judge to commit a
defendant to the Department for evaluation or treatment
under certain circumstances; providing that the time spent
by a defendant in evaluation and treatment shall be credited
against the sentence imposed by a court; establishing
certain responsibilities of the Department; clarifying
provisions relating to the confidentiality of alcohol and
drug abuse patient records; providing for a delayed
effective date; and generally relating to the provision of
services to intoxicated individuals and to individuals with
alcohol or drug abuse problems.
BY repealing and reenacting, with amendments,
Article - Health - General
Section 8-101; 8-501 through 8-503, inclusive, to be under
the amended subtitle "Subtitle 5. Alcohol and Drug
Abuse - Publicly Intoxicated Individuals, Court
Ordered Evaluations, and Voluntary Treatment"; 8-801
to be under the amended subtitle "Subtitle 6.
Privileged Information"; and 8-901 to be under the
amended subtitle "Subtitle 7. Prohibited Acts;
Penalties"
