Ch. 3

LAWS OF MARYLAND

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 56, § 276.
It is rephrased in the standard language now used
throughout the revised articles of the Code for
provisions that allow or require waiver of
qualifications.

In subsection (b)(1) of this section, the reference to
an "application" fee is added for clarity.

Defined terms: "Board" § 9-101
"License" § 9-101

"Practice landscape architecture" § 9-101
"State" § 1-101

9-307. ISSUANCE OF LICENSE.

(A)  NOTICE TO QUALIFIED APPLICANT.

IF AN APPLICANT QUALIFIES FOR A LICENSE UNDER THIS SUBTITLE,
THE BOARD SHALL SEND THE APPLICANT A NOTICE THAT STATES THAT:

(1)  THE APPLICANT HAS QUALIFIED FOR A LICENSE; AND

(2)  ON RECEIPT OF THE LICENSE FEE SET BY THE BOARD,
THE BOARD WILL ISSUE A LICENSE TO THE APPLICANT.

(B)  ISSUANCE.

ON PAYMENT OF THE LICENSE FEE, THE BOARD SHALL ISSUE A
LICENSE TO EACH APPLICANT WHO MEETS THE REQUIREMENTS OF THIS
SUBTITLE.

REVISOR'S NOTE: Subsection (a)(1) of this section is new
language added to state expressly that the Board must
give notice to qualified applicants. This addition
conforms to the practice of the Board.

Subsection (a)(2) of this section is new language
derived without substantive change from the first
sentence of former Art. 56, § 278(h) and, as it
related to payment of a license fee, § 273(3) and
rephrased as part of the notice requirement.

Subsection (b) of this section is new language added
to state expressly that which only was implied in the
former law -- i.e., the Board must issue a license to
a qualified applicant.

As to the authority of the Board to set fees, see §
9-207 of this title.
