Ch. 3

It provides an element of fundamental fairness by

requiring the Board to give qualified applicants

specific notice before the administration of
examinations.

Subsection (d) of this section is new language derived
without substantive change from the fourth sentence
and, except for the references to announcement of and
times for examination, the second sentence, and, as it
related to the scope of examination, the third
sentence of former Art. 56, § 274.

In subsection (b) of this section, the reference to
the "place" that the Board determines is added for
clarity and consistency with similar provisions
elsewhere in this article.

In subsection (d)(1) of this section, the references
to determining the "form" of and "passing score" for
examinations are added for consistency with similar
provisions elsewhere in this article.

9-306. RECIPROCITY.

(A)  IN GENERAL.

SUBJECT TO THE PROVISIONS OF THIS SECTION, THE BOARD MAY
WAIVE ANY REQUIREMENT OF THIS SUBTITLE FOR AN APPLICANT WHO IS
LICENSED TO PRACTICE LANDSCAPE ARCHITECTURE IN ANOTHER STATE.

(B)  CONDITIONS.

THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF THE
APPLICANT:

(1)  PAYS THE APPLICATION FEE REQUIRED UNDER § 9-304
OF THIS SUBTITLE; AND

(2)  PROVIDES ADEQUATE EVIDENCE THAT, AT THE TIME THE
APPLICANT WAS LICENSED IN THE OTHER STATE, THE APPLICANT WAS
REQUIRED TO PASS AN EXAMINATION AND MEET QUALIFICATIONS THAT WERE
SUBSTANTIALLY EQUIVALENT TO THE EXAMINATION AND QUALIFICATIONS IN
THIS STATE.

(C)  RECIPROCITY.

THE BOARD MAY GRANT A WAIVER UNDER THIS SECTION ONLY IF THE
STATE IN WHICH THE APPLICANT IS LICENSED WAIVES THE EXAMINATION
AND QUALIFICATIONS OF LICENSEES OF THIS STATE TO A SIMILAR EXTENT
AS THIS STATE WAIVES THE EXAMINATION AND QUALIFICATION
REQUIREMENTS FOR INDIVIDUALS LICENSED IN THAT STATE.
