Ch. 745                                       LAWS OF MARYLAND

county collector shall [remit that revenue to the Comptroller for
deposit in the Maryland Agricultural Land Preservation Fund]
TRANSFER THE FUNDS TO THE COUNTY'S PROGRAM OPEN SPACE ACCOUNT.
THE COUNTY MAY USE THE FUNDS TRANSFERRED UNDER THIS PARAGRAPH IN
ADDITION TO ANY FUNDS THAT WOULD OTHERWISE BE ALLOTTED TO THE
COUNTY UNDER § 5-903 OF THE NATURAL RESOURCES ARTICLE, FOR THE
ACQUISITION AND DEVELOPMENT OF LAND FOR RECREATION AND OPEN SPACE
PURPOSES. LOCAL GOVERNING BODY MAY DIRECT THE COUNTY COLLECTOR
TO:

(I) TRANSFER THE REVENUE TO THE COUNTY'S

PROGRAM OPEN SPACE ACCOUNT TO BE USED SOLELY FOR THE ACQUISITION
OF WOODLAND OR PURCHASE OF AGRICULTURAL EASEMENTS FOR RECREATION
AND OPEN SPACE PURPOSES; OR

(II) REMIT THE REVENUE TO THE COMPTROLLER FOR
DEPOSIT IN THE MARYLAND AGRICULTURAL LAND PRESERVATION FUND.

UNDER THIS PARAGRAPH MAY BE
USED ONLY TO ACQUIRE WOODLAND OR TO
PURCHASE AGRICULTURAL EASEMENTS

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1989. It shall remain effective for a period
of two years and, at the end of June 30, 1991, with no further
action required by the General Assembly, this Act shall be
abrogated and of no further force and effect.
